Introduction / Acceptance of Terms
Welcome to ProKast. We are an Australian company based in Melbourne, Victoria, supplying high-quality neodymium precast concrete magnets and magnetic steel chamfers to the B2B construction and precast industry.
These Terms & Conditions of Sale apply to all orders placed with ProKast. By requesting a quote, accepting a quote, or placing an order with us, you agree to be bound by these terms. Please read them carefully.
Orders and Pricing
All quotes provided by ProKast are valid for the period stated on the quote (or 30 days if not specified). We reserve the right to amend pricing if raw material costs or freight charges change significantly before an order is confirmed.
- Orders are considered accepted only once we have issued an order confirmation or invoice.
- All prices are listed in Australian Dollars (AUD) and are exclusive of GST and freight unless explicitly stated otherwise.
- Custom orders or specialized bulk requests may require a non-refundable deposit prior to manufacturing.
Payment Terms
Payment terms will be specified on your invoice. For new customers, full payment is generally required prior to dispatch. For approved account holders, standard trading terms apply (e.g., 30 days from end of month, subject to credit approval).
If payment is not received by the due date, ProKast reserves the right to suspend future deliveries and may apply reasonable interest charges on the overdue amount.
Delivery & Shipping
We dispatch from our Melbourne warehouse and ship Australia-wide. Delivery timeframes are estimates only and are not guaranteed.

Risk and Title
The transition of risk and ownership is a standard part of our B2B transactions:
- Risk: The risk of loss or damage to the goods passes to you (the customer) once the goods are dispatched from our warehouse and handed to the freight carrier.
- Title (Retention of Title): Ownership (title) of the goods remains with ProKast and does not pass to you until we have received full and cleared payment for the goods and any associated freight charges.
ProKast Warranty & Returns
We stand behind the durability of our tools. We offer a voluntary warranty of 24 months for our precast concrete magnets and 12 months for our magnetic steel chamfers against manufacturing defects.
Australian Consumer Law (ACL): All sales are subject to the Australian Consumer Law. Our voluntary warranty is in addition to, and does not override or limit, your consumer guarantees under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

Our Liability
To the maximum extent permitted by law (and subject always to the ACL):
- ProKast’s liability for any defect, delay, or failure of the goods is limited to the repair or replacement of the goods, or the refund of the purchase price.
- We are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, project delays, or downtime in your precast yard arising from the use or inability to use our products.
Intellectual Property
All intellectual property rights in the design, engineering, and branding of ProKast products remain the exclusive property of ProKast. Purchasing our goods does not grant you any right to reproduce, copy, or reverse-engineer our magnetic systems or chamfers.
Force Majeure
ProKast will not be liable for any delay or failure to perform our obligations under these terms if such delay is caused by events beyond our reasonable control. This includes, but is not limited to, natural disasters, industrial disputes, severe freight network disruptions, or global raw material shortages.
Governing Law & Jurisdiction
These Terms & Conditions of Sale are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these terms or your purchase shall be subject to the exclusive jurisdiction of the courts of Victoria.
Changes to Terms
ProKast reserves the right to update or modify these Terms & Conditions of Sale at any time without prior notice. The terms applicable to your order will be those published on our website at the time your order is placed.
